Who we are

Fiona Tomlinson Photography Ltd (“we”, “us”, “our”) provides photography services across New Zealand, including dog/animal photography and portrait/headshot sessions.

We respect your privacy and handle personal information in line with New Zealand privacy law.

What we collect

We collect personal information when you contact us (call/text/email), submit a website form, submit a Meta (Facebook/Instagram) lead form, book a shoot, order prints, or interact with our website/ads.

Depending on what you do, we may collect:

  • name, email, phone number, city/region

  • enquiry and booking details (shoot type, dates/times, location(s), notes you provide)

  • communications (texts, emails, social messages, and call notes)

  • payment/admin records (deposit/payment status, invoices/receipts, transaction references — we do not store full card numbers)

  • photographs/video that may identify you (and sometimes your family), plus file information/metadata

  • print order and delivery details (if you order prints)

  • website/advertising data collected via cookies/pixels (see “Cookies & tracking”)

If you submit a Meta instant form, we receive the information you provide in that form (e.g., name, email, phone, and answers to form questions).

Why we collect it and how we use it

We collect and use personal information to:

  • respond to enquiries, provide quotes, and confirm bookings

  • plan shoots and communicate logistics

  • deliver images (typically via WeTransfer unless agreed otherwise)

  • process deposits/payments and keep business/admin records

  • arrange print orders and delivery (if you order prints)

  • measure and improve our website and advertising (Google and Meta tools)

  • protect our business and clients (e.g., preventing fraud, handling disputes, keeping records)

We only use personal information for purposes connected to why it was collected, unless you agree otherwise or we’re legally allowed/required to.

If you don’t provide information

You can choose not to provide personal information, but it may mean we can’t respond properly, confirm a booking, take a deposit, deliver images, or fulfil print orders.

Who we share information with

We do not sell your personal information. We share it only when needed to run the business or deliver services, including with:

  • website and forms provider (e.g., Squarespace)

  • Meta (Facebook/Instagram) where you submit lead forms or interact with ads

  • analytics/advertising providers (Google and Meta tools)

  • payment providers (to process deposits/payments)

  • WeTransfer (or another agreed delivery tool) to deliver images

  • print providers and couriers (if you order prints)

  • professional advisers (e.g., accountant) as needed for business administration

  • editing contractors (sometimes overseas) for specialised or time-consuming editing

Overseas storage and access

Some services we use (including Meta, Google, WeTransfer, and editing contractors) may store or process information outside New Zealand. This can include your contact details and/or image files. We take reasonable steps to use reputable providers and limit what’s shared to what’s necessary.

How we store and protect your information

We take reasonable steps appropriate for a small business to protect personal information, including limiting access and using strong passwords and security settings where available. No system is 100% secure.

If a privacy breach occurs, we will assess it and notify affected people and the Office of the Privacy Commissioner if required.

How long we keep information

Images: We generally keep client images indefinitely on a hard drive for archiving and potential re-orders. However, we cannot guarantee indefinite safekeeping (for example, due to device failure, corruption, loss, or other unforeseen events). We recommend you download and back up your delivered images promptly.

Other records: We keep booking, payment, and admin records for as long as reasonably needed for business purposes and recordkeeping.

Deletion requests: You can request deletion of your personal information and/or images. We’ll take reasonable steps to comply unless we need to keep certain information for legitimate business recordkeeping or legal reasons (in which case we’ll explain what we’re keeping and why).

Access and correction

You can ask for access to the personal information we hold about you and ask us to correct it if you believe it is wrong. Email fiona@fionatomlinson.co.nz. We may need to confirm your identity before releasing information.

Marketing (email + SMS) and opting out

If you subscribe to our newsletters/updates, you can unsubscribe at any time using the link in the email (where provided) or by contacting us.

We may send SMS booking reminders/updates and promotional messages. You can opt out of promotional SMS at any time by replying STOP (or by telling us directly). Even if you opt out of marketing, we may still send essential service messages needed to manage your booking and deliver your images.

Portfolio and social media use of images

We will only use identifiable client images for our website/portfolio/social media with your permission. You can withdraw permission for future use at any time (this won’t affect content already published before you withdrew consent).

Cookies and tracking

Our website may use cookies and similar technologies to make the site work, understand visitor use, and measure/improve advertising (including Google and Meta tools). You can control cookies through your browser settings and, if enabled, our cookie banner/preferences tool.

Links to other websites

Our site may link to third-party services (e.g., Instagram/Facebook). Those services have their own privacy policies and practices.

Complaints

If you have a privacy concern, please contact us first at fiona@fionatomlinson.co.nz and we’ll try to resolve it promptly. If you’re not satisfied, you can complain to the Office of the Privacy Commissioner.
